Welcome to Saakshya. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Liberin Technologies ("Saakshya," "we," "us," or "our") governing your access to and use of the Saakshya platform and services.

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.

These Terms apply to all users of our platform, including organizations, administrators, and end users.

2. Definitions

• "Platform" means the Saakshya certificate management platform, including all software, applications, APIs, and related services.
• "Services" means all features, functionalities, and services provided through the Platform.
• "Customer Data" means all data, content, and information submitted by you to the Platform.
• "Certificate" means digital credentials generated through our Platform.
• "Account" means your registered account on the Platform.
• "Subscription" means your paid plan or service tier.

3. Account Registration

3.1 Eligibility

To use our Services, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal authority to enter into this agreement
• Provide accurate and complete registration information
• Not be prohibited from using our Services under applicable law

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate and current

3.3 Organization Accounts

If you register on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. Services and Features

4.1 Platform Access

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Platform for your internal business purposes.

4.2 Service Features

Our Platform provides:

• Certificate design and template creation
• Bulk certificate generation and processing
• Blockchain-based certificate verification
• Automated distribution via email, SMS, and WhatsApp
• Analytics and reporting dashboards
• API access for integrations
• Certificate verification portal

4.3 Service Levels

We strive to maintain:

• 99.9% platform uptime (excluding scheduled maintenance)
• Regular security updates and patches
• 24/7 support for Enterprise customers
• Data backup and disaster recovery procedures

4.4 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Services with reasonable notice. We are not liable for any modification, suspension, or discontinuance of the Services.

5. Pricing and Payment

5.1 Subscription Plans

We offer various subscription plans with different features and pricing. Current pricing is available on our website and may be updated from time to time with notice.

5.2 Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or stated in these Terms
• You authorize us to charge your payment method automatically
• Failed payments may result in service suspension

5.3 Price Changes

We may change our pricing with 30 days' notice. Price changes will apply to renewals after the notice period.

5.4 Taxes

6. Acceptable Use Policy

• Generate fraudulent, misleading, or false certificates
• Attempt to gain unauthorized access to the Platform or other accounts
• Interfere with or disrupt the Platform's operation
• Use the Platform for any unlawful, harmful, or malicious purposes
• Reverse engineer, decompile, or disassemble any aspect of the Platform
• Remove or modify any proprietary notices or labels
• Use the Platform to transmit viruses, malware, or harmful code
• Resell or redistribute our Services without authorization
• Use automated means to access the Platform except through our API

6.2 Content Standards

All certificates and content must:

• Be accurate and not misleading
• Comply with applicable credential and certification standards
• Not infringe on third-party intellectual property rights
• Not contain offensive, discriminatory, or illegal content

6.3 Compliance

You are responsible for ensuring your use of the Platform complies with all applicable laws, regulations, and industry standards in your jurisdiction.

7. Intellectual Property

7.1 Our Rights

We retain all rights, title, and interest in the Platform, including all software, designs, trademarks, and proprietary technology. These Terms do not grant you any ownership rights.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms.

7.3 Feedback

Any feedback, suggestions, or ideas you provide about the Platform become our property, and we may use them without obligation to you.

8. Data Ownership and Rights

You retain all rights to your Customer Data. You grant us a license to use, store, and process your Customer Data solely to provide the Services.

We implement industry-standard security measures to protect your data. However, you are responsible for backing up your data and maintaining appropriate security on your end.

8.3 Data Privacy

Our use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.4 Blockchain Records

Certificate verification data stored on blockchain is permanent and immutable by design. You acknowledge that blockchain records cannot be deleted or modified.

8.5 Data Portability

You may export your data at any time through our platform tools or by contacting support.

9. Warranties and Disclaimers

9.1 Our Warranties

We warrant that:

• We will provide the Services with reasonable skill and care
• We have the right to provide the Services to you
• We will comply with applicable laws in providing the Services

9.2 Disclaimer

EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. We are not responsible for delays, failures, or problems caused by factors outside our reasonable control.

10. Limitation of Liability

10.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10.2 Excluded Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

10.3 Exceptions

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by law

11. Termination

11.1 Termination by You

You may terminate your subscription at any time through your account settings. Termination will be effective at the end of your current billing period.

11.2 Termination by Us

We may suspend or terminate your account if:

• You breach these Terms
• Your account is involved in fraudulent or illegal activity
• Your payment method fails
• Required by law or legal process

11.3 Effect of Termination

Upon termination:

• Your access to the Platform will cease
• You must pay all outstanding fees
• You may request data export within 30 days
• We may delete your data after 90 days (except blockchain records)

11.4 Survival

Sections relating to intellectual property, liability, indemnification, and dispute resolution survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law provisions.

12.2 Dispute Resolution
